Early Childhood Investigations Webinars is an ongoing series of webinars for the early education community. Early Childhood Investigations Webinars (“ECI” or the “Site”) is owned and operated by Carline, Inc., a Delaware corporation doing business as Playground (“the Company”), which produces the Early Childhood Investigations (ECI) and Playground webinar programs. The webinars are presented by nationally and internationally recognized experts and may be sponsored by companies and organizations that sell products or services to early childhood education programs or educators.
This agreement describes the terms under which you (the “User”) may access and use ECI and its associated services. By using the Site, registering for any webinar, or accessing the recordings, archives, or other materials on the Site, you signify that you have read, understand, and agree to be bound by this User Agreement and our Privacy Policy.
User Eligibility
Professionals involved in early education, or individuals with an interest in early education, are eligible to use the Site and participate in the webinars. Anyone 18 years of age or older may use the Site. Anyone under 18 is not permitted to join ECI or log into any live webinar on their own. The Company is not responsible if an individual who is not eligible joins the Site. Membership is void where prohibited.
Terms of Conduct
As a Site visitor or webinar participant, you agree to participate in a professional and constructive manner and to post only relevant information in the questions pane or chat during webinars. You agree not to post solicitations or promotional offers; not to post invitations to webinars, events, surveys, or similar activities without the permission of the Company, the sponsoring organization, or the presenter; and not to use the Site’s search functionality to identify and directly solicit presenters. The Company reserves the right to remove any post, dismiss you from a session, and/or block you from future webinars for conduct inconsistent with this Agreement.
Prohibited Activities
You agree not to: forge headers or manipulate identifiers to disguise the origin of any communication or material transmitted through ECI, including Certificates; use automated scripts or data-gathering processes to collect information from the Site or any webinar; use ECI in any way that could damage, impair, or interfere with the Site; use content or data obtained from ECI to provide any service competitive with the Company, a presenter, or a sponsor; attempt to override any security component of ECI; or use ECI in any unlawful manner.
Personal Use
The Company grants you permission to access and use ECI. You may not download, copy, or modify any content on the Site except resources intended to be shared with you by presenters, hosts, and sponsors. Your permission does not include any resale or commercial use of Site contents, or any data mining or information gathering.
Organizational Use
There is no charge for individuals, schools, colleges, or state-level or local non-profit organizations to use ECI or attend webinars, unless clearly specified. The Company charges sponsorship fees for other organizations and for-profit companies to promote their products and services during webinars, on the Site, and in email messages. Registration
You agree to register as an individual, not an institution, using your real name and accurate information, and not to impersonate any person or misrepresent your affiliations. If the Company has reasonable grounds to suspect your information is untrue or inaccurate, it may suspend or terminate your access. You authorize the Company to update your email address if it receives a change-of-email notice from you.
Continuing Education & Certificates
Webinars that meet the Company’s IACET-accredited instructional standards may award Continuing Education Units (CEUs) and corresponding certificates, as determined by the Company. You are responsible for accessing and retaining your own copies of any certificates or materials issued to you or made available through the Site.
User Content
The Company does not endorse or guarantee the accuracy of any content on the Site or in a webinar. You are responsible for all content you upload, post, or transmit during webinars, including its copyright, accuracy, appropriateness, and legality. “Content” includes posts, text, documents, files, messages, images, audio and video, and any other information you provide.
Intellectual Property Rights
Attendees must respect and follow all laws regarding intellectual property and may not abuse the copyrights on any materials posted on the Site or made available during webinars. The Company’s and ECI’s names, logos, and related identities are trademarks of Carline, Inc. d/b/a Playground; you agree not to display or use them without the Company’s prior written permission, and not to duplicate or reuse any portion of the Site’s HTML/CSS, JavaScript, or visual design without express written permission. Termination
The Company may terminate your access without prior notice if there is reason to suspect you are not in compliance with this User Agreement or the Privacy Policy, if your email address is determined to be invalid, if you request deletion of your email address, or in response to a request by law enforcement or a government agency. The Company shall not be liable to you or any third party for any such termination.
Third-Party Services and Offers
In connection with your use of ECI you may take advantage of third-party offers, services, or products, including offers by sponsors or presenters. The Company is not responsible for the performance of any third party, and their inclusion does not imply affiliation or endorsement. If you leave ECI to access a third-party site, you do so at your own risk and this User Agreement no longer applies.
Core Engine and Hosting
The Company works with subcontractors and service providers for the core engine, webinar hosting, servers, and system maintenance. These contractors act on the Company’s behalf and are contractually required to maintain confidentiality. The Company does not own the core platforms that power, distribute, and host the webinars and emails; if a problem arises with a platform or a subcontractor ceases operations, the Company shall have no liability for service interruptions or discontinuance.
International Use
If you use ECI from outside the United States, you consent to the transfer of your information to the United States for processing and maintenance in accordance with this User Agreement and the Privacy Policy, and to the application of United States law in all matters concerning the Site.
Indemnification
You agree to indemnify and hold harmless the Company, Carline, Inc. d/b/a Playground, and its officers, managers, employees, agents, subsidiaries, affiliates, and partners from any damages resulting from your use of ECI, unauthorized access to or alteration of your communications, or any other matter relating to ECI. Any interaction between users is the sole responsibility of the users involved. You understand that the Company may disclose personally identifiable information if required by law or in the good-faith belief that disclosure is reasonably necessary to comply with legal process, enforce this Agreement, or protect the rights, property, or safety of the Company, its users, and the public.
Disclaimer of Warranties
ECI is provided on an “AS IS” and “AS AVAILABLE” basis. The Company assumes no responsibility for the prompt or proper delivery or retention of any user information or communications, and expressly disclaims all warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company makes no warranty that ECI will meet your requirements; be uninterrupted, timely, secure, or error-free; or produce accurate or reliable results. Any material obtained through ECI is done at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
Limitation of Liability
The Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, or data, even if advised of the possibility of such damages. The Company reserves the right to modify or discontinue ECI or its services at any time without liability. Where jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, liability shall be limited to the extent permitted by law.
Governing Law and Arbitration
These Terms are governed by and will be construed under the Federal Arbitration Act, applicable federal law, and the laws of the State of California, without regard to its conflict-of-law principles.
The parties shall use their best efforts to settle any dispute, claim, question, or disagreement arising out of or relating to the subject matter of these Terms directly through good-faith negotiations, which shall be a precondition to either party initiating arbitration. If such negotiations do not resolve the dispute, it shall be finally settled by binding arbitration in Los Angeles County, California. The arbitration will proceed in the English language, in accordance with the JAMS Streamlined Arbitration Rules and Procedures then in effect, by one commercial arbitrator with substantial experience in resolving commercial contract disputes. The arbitrator shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
Entire Agreement
This User Agreement constitutes the entire agreement between you and the Company and governs your use of ECI, superseding any prior agreements. The Company may make periodic changes to this Agreement; you are responsible for checking the Site for changes, and the date of the last revision will appear at the top. Continued use of ECI constitutes your acceptance of the updated Agreement.
Communications
By registering for ECI, you consent to be contacted by email regarding your use of ECI, including notifications necessary for the normal functioning of the service. Upon registering for a webinar, you may opt in to receive email from the Company, the presenter, and the sponsor of the sessions you attend. You may unsubscribe from Company email at any time via the “unsubscribe” link, or change your preferences via “Manage Preferences.” Management of subscriptions with sponsors and presenters is not the responsibility of the Company.
